Calvert County Health Department states:
A burning permit is required from the Environmental Health Division for any open air burning. Permits will not be issued from June 1 through August 31st of each year due to air quality restrictions.
The fee for burning permits is $10.00
Maryland DNR states:
A person may not engage in open air burning except under the following conditions:
1.There is a natural or constructed fire break at least 10 feet wide completely around the material to be burned that is free of flammable materials;
2.Adequate personnel and equipment are present to prevent the fire from escaping;
3.At least one responsible person remains at the location of the fire until the last spark is out; and
4.Burning occurs between the hours of 4:00 pm and 12:00 midnight EST, except when the ground is covered with snow the burning may occur at any time so long as all other requirements are met.
In addition to the requirements of this regulation, a person engaged in open air burning shall comply with all other requirements of other state and local jurisdictions. (Inclduing EPA & calvert County)

If you live within the town limits of Chesapeake Beach, North Beach or within the Chesapeake Ranch Estates you can never open air burn.
Why is there no open air burning in Chesapeake Beach, I live on the corner of 260 and cox road, I have been clearing my land and the towns land for the last 3 years of old dead trees vines that kill and wrap around all of the trees, and I am almost done clearing the land, and today I had a 100 year old tree that was struck by lightning a month ago, I just cut that down, we’re do I take all of the trees and vines to if I can’t burn this wood ???????

The Town of Chesapeake Beach has its own rules and regulations. According to Chapter 140, Section 3, they do not authorize burning on private property of any kind, to include fuel, wood, leaves, wastepaper, brush, trash etc. To further address you concern, I would suggest contacting the Public Works Administrator, James Berry at jberry@chesapeakebeachmd.gov.

Does the burn law,apply to household trash? I have a neighborhood throwing white plastic household bags in his burn barrel in his back yard. God only knows what toxins are being released into the air.

The regulation is defined as a fire with any burning material. You may want to contact the State Fire Marshall or the Department of Natural Resources for more specific details. Your neighbor should be following all regulations such as only burning during the regulated hours.
